1. Acceptance of Terms
These Terms of Service (“Terms”) govern access to and use of the website, broadband connectivity services, enterprise leased-line circuits, managed Wi-Fi solutions, and event bandwidth deployments provided by Bakcom Networks (India) Private Limited (“Bakcom”, “we”, “us”, or “our”).
By accessing this website, submitting a connection enquiry, signing a subscriber agreement, or activating any Bakcom service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our website or services.
2. Scope of Services
Bakcom is a licensed Internet Service Provider (ISP) offering last-mile fibre and high-capacity wireless broadband connectivity across South Delhi. Our services include, but are not limited to:
- Premium Residential Broadband: Dedicated or shared fibre connections for private homes, bungalows, multi-storey residences, and diplomatic households.
- Enterprise Leased Lines & Dedicated Internet Access (DIA): Uncontended, SLA-backed leased circuits for embassies, corporate offices, hotels, and institutions.
- Managed Wi-Fi Solutions: Turnkey Wi-Fi design, installation, and ongoing management for residential complexes, offices, and hospitality properties.
- Events Bandwidth: High-capacity temporary connectivity for conferences, exhibitions, diplomatic receptions, and large outdoor events.
All services are subject to a prior optical or wireless feasibility survey and right-of-way clearance within approved South Delhi corridors. Bakcom reserves the right to decline service in areas outside its operational network coverage.
3. Subscriber Agreements & Service Orders
All active connections are governed by an individual Subscriber Agreement or Service Order Form (“SOF”) that specifies the selected plan, contracted bandwidth, installation terms, monthly recurring charges, SLA commitments, and notice periods.
In the event of a conflict between these general Terms of Service and a specific Subscriber Agreement, the Subscriber Agreement shall prevail for that individual connection.
4. Acceptable Use Policy
You agree not to use Bakcom services to:
- Transmit, distribute, or store any content that violates applicable Indian law, including the Information Technology Act, 2000 and TRAI regulations.
- Engage in any activity that disrupts, degrades, or impairs the network performance or security of other subscribers or third-party systems.
- Operate a commercial resale service on a residential plan without Bakcom's prior written consent.
- Attempt to circumvent or tamper with CPE equipment, network ports, or management interfaces supplied by Bakcom.
Violation of this Acceptable Use Policy may result in service suspension or termination without prior notice.
5. Subscriber Obligations
- Accurate Information: You must provide accurate KYC documentation and contact details during onboarding and promptly notify Bakcom of any changes.
- Equipment Care: CPE equipment (ONUs, routers, antennas) supplied by Bakcom remains our property. You are responsible for its safe custody and must report damage or theft promptly.
- Access for Maintenance: You agree to provide reasonable access to your premises for installation, maintenance, and decommissioning activities by Bakcom technicians.
- Timely Payment: Subscription invoices are payable by the due date specified on the invoice. Overdue accounts may be suspended after a 7-day grace period.
6. Service Levels & Planned Maintenance
SLA uptime commitments (where applicable) are specified in the individual Subscriber Agreement or Enterprise SOF. Bakcom maintains a Dual-NOC architecture and on-ground field engineers in South Delhi to ensure rapid fault resolution.
Planned maintenance activities are notified at least 24 hours in advance where reasonably possible. Emergency maintenance may be carried out without prior notice to protect network integrity.
Service availability may be affected by factors outside Bakcom's control, including force majeure events, upstream provider outages, civil works, or government-mandated restrictions.
7. Billing, Refunds & Disconnection
- All prices are inclusive of applicable taxes unless stated otherwise on the invoice.
- Advance payments (where applicable) are non-refundable once a connection has been activated, except in cases where Bakcom is unable to deliver the committed service.
- You may request voluntary disconnection by providing 30 days' written notice (email to care@bakcom.in is acceptable). CPE equipment must be returned in good working condition.
8. Confidentiality
Bakcom treats all non-public subscriber information disclosed during onboarding, fault diagnosis, and ongoing support as strictly confidential. We do not disclose subscriber identity, usage patterns, or network configuration details to any third party except as required to deliver the service, comply with Indian law, or respond to lawful government orders.
9. Intellectual Property
All content on this website — including text, graphics, logos, service descriptions, and design elements — is the property of Bakcom Networks (India) Private Limited and is protected under Indian copyright law. You may not reproduce, distribute, or use any content without prior written permission.
10. Limitation of Liability
To the maximum extent permitted by applicable Indian law, Bakcom and its directors, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to service interruptions caused by upstream provider outages, force majeure events, civil or government works, or subscriber-side equipment failure.
Our aggregate liability for any direct claim under a specific Subscriber Agreement shall be limited to the total monthly recurring charges paid by the subscriber in the preceding three (3) months.
11. Governing Law & Jurisdiction
These Terms of Service and all related subscriber agreements shall be governed by and construed in accordance with the laws of the Republic of India.
Any disputes arising out of or relating to these Terms, or the breach or termination thereof, shall be subject to the exclusive jurisdiction of the competent courts located in New Delhi, India.
12. Amendments
Bakcom reserves the right to update these Terms at any time. Material changes will be communicated to active subscribers via email or our website. Your continued use of our services after such notification constitutes acceptance of the revised Terms.
